Mapica Terms of Use and Sale
These Terms of Use and Sale (“Terms”) govern your use of the Mapica mobile application, mapica.app, public Local Creator and route pages, and related Mapica services.
Please read these Terms before creating an account, purchasing or using a route, requesting a Personal Trip, publishing content, or participating in Mapica as a Local Creator.
By creating an account or using Mapica, you agree to these Terms. When you make a paid purchase, the product, price, delivery information, payment information and any specific terms shown immediately before purchase also form part of your contract.
1. Who operates Mapica
Mapica is currently in pre-launch. The French legal entity that will operate paid Mapica commercial services is in the process of incorporation.
Its legal name, registered office, registration details, VAT information where applicable, business telephone number and consumer mediator will be published here before paid commercial services are launched.

“Mapica”, “we”, “us” and “our” refer to the Mapica service and, following incorporation, to the legal entity identified in this section.
Paid commercial services must not be offered under the name of the future legal entity before that entity has been validly incorporated and its legally required information has been published.
2. What Mapica is
Mapica is a travel technology platform that helps travelers discover, request and use travel plans created with local knowledge.
Mapica may provide:
- personalized travel planning;
- Personal Trips prepared with Local Creators;
- ready-made digital routes;
- maps and itinerary timelines;
- place information and recommendations;
- traveler and Local messaging;
- AI-assisted travel planning and chat;
- public Local Creator profiles;
- public route pages;
- ratings and reviews;
- links to independent travel-booking partners.
Mapica is a digital travel-planning service.
Unless expressly stated otherwise for a particular product, Mapica does not provide a physically accompanied tour and a Local Creator does not accompany the Traveler during the trip.
3. Travelers and Local Creators
Mapica uses one account system.
A user may use Mapica as a Traveler and may later apply to become a Local Creator without creating a separate account.
A Traveler is a user who browses, requests, purchases or uses Mapica travel content or services.
A Local Creator, or Local, is a user approved by Mapica to contribute local knowledge, prepare Personal Trips, create routes or publish travel content through Mapica.
Approval as a Local Creator does not guarantee orders, sales, visibility, income or continued access to any particular Mapica feature.
4. Age and eligibility
You must be at least 16 years old to create a Mapica user account.
If the law applicable to you requires a higher age or parental consent, that requirement applies.
You must be at least 18 years old and legally capable of entering into the relevant commercial relationship to provide paid creator services through Mapica.
You may not use Mapica where applicable law prohibits you from doing so.
5. Accounts
You must provide accurate information and keep relevant account information reasonably up to date.
You are responsible for:
- keeping your credentials secure;
- activity carried out through your account;
- notifying Mapica if you believe your account has been compromised.
Authentication may be provided through email, Apple, Google or another method made available by Mapica.
You may not sell, rent or transfer your Mapica account to another person.
You may delete your Mapica account using the account-deletion functionality available in the app.
6. Personal Trips
A Traveler may request a personalized travel plan based on information such as:
- destination;
- travel dates;
- number and type of travelers;
- children traveling with the group;
- interests;
- preferred pace;
- budget;
- accommodation;
- transport;
- other preferences or messages voluntarily provided by the Traveler.
Before a paid order is confirmed, Mapica will display the essential characteristics of the Personal Trip, the total price and the expected delivery time or period.
A delivery indication such as “within 24 hours” is an undertaking or estimate only where it is shown as part of the specific order.
The Traveler is responsible for providing information that is reasonably accurate and sufficient to prepare the requested trip.
A Personal Trip is a travel-planning service. It does not itself reserve or guarantee:
- accommodation;
- attraction admission;
- restaurant tables;
- transport;
- weather;
- third-party prices;
- third-party availability.
7. Ready Routes
Mapica may offer ready-made digital travel routes created with Local Creators.
A Ready Route may contain:
- places;
- descriptions;
- photographs;
- map locations;
- sequence and timing;
- walking or travel estimates;
- recommendations;
- Local tips;
- links to independent travel providers.
After a valid purchase, the Traveler receives a personal, limited, non-exclusive and non-transferable right to use the Ready Route through Mapica for personal travel purposes.
Purchase does not transfer copyright or ownership of the route.
A purchased route may not be reproduced, resold, commercially redistributed, scraped or republished except where applicable law expressly permits it.
8. Who sells Mapica products
Once paid Mapica commercial services are launched and unless Mapica expressly states otherwise before purchase:
Mapica is the seller and contracting party for paid Ready Routes and Personal Trips purchased as Mapica products.
A Local Creator may create, contribute to or perform work used to provide the Mapica product, but the Local is not the Traveler's merchant of record for that purchase.
The Traveler therefore contacts Mapica regarding:
- payment;
- delivery;
- refunds;
- consumer rights;
- complaints concerning the Mapica product.
Mapica may separately compensate the Local Creator under the commercial terms applicable between Mapica and that Local.
This seller model does not apply to independent travel services reached through partner links as described below.
9. Prices and payments
The total price applicable to a Mapica purchase is displayed before the Traveler confirms the order.
Where required by law, prices shown to consumers include applicable taxes.
For sales to consumers in France, prices are presented in euros inclusive of applicable taxes where required.
Mapica products may be paid through the payment method or payment flow displayed at checkout.
Depending on the device, operating system, territory and purchase flow, payment services may be provided through Apple-authorized payment functionality, Stripe, or another payment service provider disclosed at checkout.
Payment providers may process payment information under their own terms and privacy notices.
Mapica does not store full payment-card numbers.
The final purchase interface will clearly indicate that confirming the order creates an obligation to pay.
10. Consumer right of withdrawal
Nothing in these Terms removes a mandatory withdrawal right available to a consumer under applicable law.
10.1 General 14-day period
Where EU or French consumer law applies and no legal exception has taken effect, a consumer generally has 14 days to withdraw from a distance contract without giving a reason.
10.2 Ready Routes and immediate digital delivery
A Ready Route may constitute digital content supplied without a tangible medium.
Where Mapica provides immediate access to a paid Ready Route before expiry of the withdrawal period, Mapica will obtain the legally required:
- 1. prior express consent to begin supplying the digital content immediately; and
- 2. acknowledgement that the consumer will lose the right of withdrawal once supply begins where the law provides for that consequence.
The relevant confirmation will be provided on a durable medium where required by law.
If the legally required consent, acknowledgement or confirmation has not been obtained, the consumer's statutory rights remain unaffected.
10.3 Personal Trips and early performance
A Personal Trip is a personalized service.
If the Traveler asks Mapica to begin preparing a Personal Trip before expiry of the withdrawal period, Mapica may request an express instruction to begin performance immediately.
Where applicable law permits, if the consumer withdraws after performance has begun but before the service has been fully performed, the consumer may be responsible for a proportionate amount corresponding to the service already supplied.
Where the service has been fully performed, the withdrawal right may be lost only where the legally required prior consent and acknowledgement have been obtained.
10.4 Online withdrawal function
Where a withdrawal right remains available for a contract concluded through an online interface, Mapica provides an accessible electronic function allowing the consumer to exercise that right online during the applicable withdrawal period.
The function may be available through the relevant purchase or order details in Mapica.
After an online withdrawal request is submitted, Mapica will provide confirmation on a durable medium, including the relevant submission information, where required by law.
Consumers may also contact:

11. Refunds
Refund rights depend on:
- the type of product;
- whether performance has begun;
- whether digital content has already been supplied;
- the reason for the refund;
- the payment flow used;
- mandatory consumer law.
Nothing in these Terms limits rights to a refund, price reduction or other remedy that cannot legally be excluded.
If a payment provider operates the technical refund process, Mapica may direct the Traveler to the appropriate provider procedure.
This does not remove Mapica's responsibilities as seller where Mapica is legally responsible for the product.
12. Legal guarantee of conformity for digital content and digital services
Consumers benefit from any mandatory statutory guarantees applicable to digital content and digital services supplied by Mapica.
For consumers protected by French law, Articles L.224-25-1 et seq. of the French Consumer Code relating to the legal guarantee of conformity for digital content and digital services apply where relevant.
For Mapica products supplied on a one-off basis or through separate supplies, including Ready Routes and Personal Trips where legally applicable, the statutory French notice required by Article D.211-3 is reproduced in the French version of these Terms in Annex 2.
The professional responsible for the statutory guarantee will be the Mapica French legal entity identified in Section 1 after incorporation.
Nothing in these Terms restricts mandatory statutory consumer rights.
If Mapica later offers paid digital content or a digital service supplied continuously for a defined contractual period, these Terms will be updated where necessary to include the statutory information applicable under Article D.211-4.
13. Confirmation of purchases
Where required by applicable law, Mapica will provide confirmation of a paid contract on a durable medium.
The confirmation may include:
- product or service purchased;
- price;
- date of purchase;
- applicable Terms version;
- withdrawal information;
- consent to immediate digital supply or early performance where applicable;
- other legally required information.
Electronic confirmation may be provided by email or another durable electronic method.
14. Independent travel partners
Mapica may show links, buttons, affiliate links or deep links to independent providers of travel services, including:
- attractions and activities;
- train and bus tickets;
- accommodation;
- car rental;
- other travel products.
Partners may include services such as:
- Omio;
- Viator;
- Tiqets;
- Expedia;
- DiscoverCars;
- other providers added from time to time.
When a Traveler leaves Mapica and proceeds to an independent partner checkout, the resulting booking is a separate transaction with the partner or supplier identified by that partner.
The partner's own:
- terms;
- prices;
- availability;
- cancellation rules;
- refund policy;
- support procedures;
- privacy policy
apply to that booking.
Unless expressly stated otherwise, Mapica is not the merchant of record for independent partner bookings.
Mapica may receive an affiliate or referral commission if a Traveler completes an eligible partner transaction.
Such commission does not alter the price paid by the Traveler unless expressly disclosed otherwise.
15. Packages and linked travel arrangements
Mapica normally provides independent links to separate travel providers and does not itself combine partner travel services into a package.
A Traveler who follows an independent partner link normally enters into a separate booking directly with that provider.
However, these Terms do not override mandatory travel law.
If a particular Mapica booking flow is legally classified as a package, linked travel arrangement or another regulated travel arrangement, the rights and obligations required by the applicable law will apply.
16. Accuracy of travel information
Travel information changes frequently.
Mapica and Local Creator recommendations may become inaccurate after a route is created.
For example:
- opening hours can change;
- a venue may close;
- ticket prices can change;
- reservations may become required;
- public transport may be delayed or cancelled;
- paths may close;
- access restrictions may change;
- weather may affect the route.
Travelers should verify important time-sensitive information with the relevant venue, transport operator or official source.
Mapica does not guarantee third-party availability or third-party information that Mapica does not control.
17. Travel and personal safety
Travelers remain responsible for deciding whether a route, activity or recommendation is appropriate for their individual circumstances.
You are responsible for:
- complying with local laws and restrictions;
- observing actual conditions and signage;
- assessing weather and terrain;
- using appropriate care while walking or traveling;
- obtaining any visas, permits, insurance or documentation required for your trip.
Mapica is not an emergency service.
In an emergency, contact the appropriate local emergency services.
18. Maps, Places and navigation
Mapica may use third-party map and place-information services, including Google Maps and Google Places.
Map locations, distances, walking directions, estimated journey times and place information may contain inaccuracies.
Actual conditions and official signage take priority over information displayed in Mapica.
Do not use Mapica navigation in a way that is unsafe or unlawful.
19. AI-assisted features
Mapica may use artificial intelligence and automated systems to assist with:
- travel planning;
- recommendations;
- route organization;
- translation;
- summaries;
- search;
- chat;
- content assistance.
Where a user interacts directly with an AI system, Mapica will identify that interaction as AI where required by applicable law.
AI-generated or AI-assisted information can contain errors or outdated information.
It should not be relied upon as the sole source for important matters such as:
- safety;
- medical information;
- immigration or visa requirements;
- legal requirements;
- emergency information;
- live transport information;
- official opening times.
A Local Creator remains responsible for content that the Local chooses to publish under their own profile, including where Mapica tools assisted in drafting, organizing or translating that content.
20. Applying to become a Local Creator
Becoming a Local Creator is subject to Mapica approval.
An application may include information relating to:
- identity;
- location;
- languages;
- regions known;
- expertise;
- experience;
- sample travel content;
- other information reasonably required to assess the application.
Mapica may:
- approve the application;
- decline it;
- request additional information.
Applications are subject to human review and are not accepted or rejected solely through automated decision-making.
21. Local Creator obligations
Local Creators must:
- provide accurate information;
- publish genuine recommendations;
- only upload content they have the right to use;
- avoid misleading claims;
- comply with applicable law;
- deliver accepted work with reasonable care and skill;
- protect Traveler information;
- use Traveler information only for the Mapica task for which it was supplied;
- not copy another creator's routes;
- not publish unlawful, deceptive, discriminatory or harmful content.
Local Creators must comply with tax, registration, social-security and professional obligations that apply to their actual activity.
Nothing in these Terms artificially determines a Local Creator's employment, worker, self-employed or other legal status where mandatory law determines that status differently.
22. Local Creator verification and tax information
Mapica may be legally required to collect or verify information concerning Local Creators.
This may include:
- full legal name;
- date and place of birth;
- address;
- tax identification number;
- country of tax residence;
- VAT information;
- business registration details;
- identity documents;
- payout information.
Mapica may use this information to satisfy legal, tax, payment, anti-fraud or marketplace obligations.
Where applicable, Mapica may report legally required information concerning Local Creator activities and consideration to competent tax authorities, including where reporting obligations arise under EU platform-reporting rules.
Where applicable law permits or requires it, Mapica may delay payouts or restrict paid creator activity until required information has been provided.
23. Local Creator earnings and payouts
The earnings applicable to a Local Creator will be shown through the relevant Mapica creator interface, pricing rules or creator commercial terms.
Before publishing a paid product or accepting relevant paid work, the Local will be able to access the applicable commercial information.
Creator earnings may take account of items identified in the applicable creator pricing rules, including, where relevant:
- platform fees;
- payment or app-store processing costs;
- taxes;
- refunds;
- chargebacks;
- legally required deductions.
Completed sales will not be retroactively repriced except where required to correct an error, fraud, refund, chargeback, tax treatment or legal obligation.
Payout timing may depend on:
- successful payment;
- fraud checks;
- refund periods;
- chargebacks;
- required tax information;
- payment-provider processing.
24. Distribution of Local content
A Local Creator authorizes Mapica to distribute approved content through channels including:
- the Mapica application;
- mapica.app;
- public Local profile pages;
- public route pages;
- search-engine indexing;
- social-media promotion;
- Mapica marketing;
- Mapica partner and affiliate channels where appropriate.
Where applicable law requires Mapica to explain the principal parameters affecting ranking of professional Local content, Mapica will make that information available in an appropriate section of the service or creator terms.
Sponsored or paid placement will be identified where required by law.
25. Reviews and ratings
Reviews must reflect genuine experience.
Users may not:
- post fabricated reviews;
- review themselves using another account;
- buy or sell fake reviews;
- manipulate ratings;
- threaten or reward another person for changing a review.
Where Mapica identifies a review as verified, Mapica will use reasonable measures to associate it with the relevant Mapica transaction or experience.
Mapica may remove reviews that violate these Terms or applicable law.
26. User-generated content
Users remain responsible for content they upload, publish or send through Mapica.
You must not submit content that:
- is illegal;
- infringes intellectual-property rights;
- unlawfully discloses personal data;
- is fraudulent or deliberately deceptive;
- contains malicious software;
- threatens or seriously harasses another person;
- is otherwise prohibited by these Terms.
Mapica may moderate user-generated content in accordance with these Terms and applicable law.
27. Reporting illegal or prohibited content
Users may report content or conduct that they believe violates these Terms or applicable law through an available in-app reporting function or by contacting:
A useful report should identify:
- the content concerned;
- the route, profile, message or URL where possible;
- why the reporter believes the content is unlawful or prohibited;
- contact information where required.
Security vulnerabilities should instead be reported to:
Mapica may request additional information reasonably necessary to assess a report.
28. Moderation, restriction and appeals
Where reasonably necessary and proportionate, Mapica may:
- remove content;
- reduce content visibility;
- restrict a feature;
- suspend an account;
- terminate access.
Reasons may include:
- illegal content;
- fraud;
- serious safety concerns;
- repeated infringement;
- intellectual-property violations;
- manipulation of marketplace systems;
- serious or repeated breach of these Terms.
Where applicable law requires it, Mapica will provide the affected user with a statement of reasons and information about available review or redress mechanisms.

29. Additional protections for professional Local Creators
Where EU platform-to-business legislation applies to a professional Local Creator, Mapica will provide the protections required by that legislation.
This includes, where applicable:
- clear grounds for restriction, suspension and termination;
- reasons for relevant restriction or suspension decisions;
- an opportunity to clarify relevant circumstances;
- advance notice of material changes to business-user terms;
- a reasonable notice period of at least 15 days for relevant changes, unless a lawful exception applies;
- longer notice where required to allow necessary technical or commercial adaptation;
- the legally required notice and reasons before complete termination of the professional Local relationship, including a 30-day notice period where that requirement applies.
Nothing in these Terms removes stronger rights granted by applicable platform-to-business law.
30. Intellectual property of Local Creators and users
A user retains ownership of intellectual-property rights they hold in content they create.
By uploading or publishing content through Mapica, the user grants Mapica a non-exclusive, worldwide licence to:
- host;
- store;
- reproduce;
- technically adapt;
- format;
- display;
- make available;
- translate where required for Mapica functionality;
- distribute through Mapica;
- promote the relevant route, profile or Mapica service.
This licence is limited to operating, providing, distributing, improving and promoting Mapica and content legitimately made available through Mapica.
Where a Traveler has already lawfully purchased access to a route, Mapica may continue to make that purchased content available as reasonably necessary to honor the purchase, subject to applicable law.
Users must have the rights and permissions necessary for content they upload.
31. Mapica intellectual property
The Mapica name, trademarks, logos, application, software, interface, proprietary platform technology and original Mapica materials are owned by Mapica or its licensors.
These Terms do not transfer ownership of Mapica intellectual property to users.
Except where applicable law expressly permits it, users may not:
- copy Mapica software;
- reverse engineer the service;
- circumvent access controls;
- systematically scrape protected Mapica content;
- reproduce Mapica branding without permission;
- commercially exploit the platform outside the permissions granted by Mapica.
32. Prohibited conduct
You may not use Mapica to:
- commit fraud;
- violate applicable law;
- impersonate another person;
- harass or threaten others;
- manipulate reviews or marketplace metrics;
- create false transactions;
- distribute malware;
- compromise Mapica security;
- bypass technical restrictions;
- unlawfully collect user information;
- infringe intellectual-property rights;
- publish deliberately dangerous or deceptive content.
33. Availability and changes to the service
Mapica is an evolving technology product.
We may modify features where reasonably necessary because of:
- product development;
- security;
- changes in law;
- changes to third-party infrastructure;
- technical requirements;
- discontinuation of a feature.
Mapica does not guarantee uninterrupted availability.
Maintenance, third-party outages or circumstances outside our reasonable control may temporarily affect the service.
Changes do not remove mandatory rights relating to purchases already completed.
34. Liability
Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law.
Nothing in these Terms limits:
- mandatory consumer rights;
- liability for fraud;
- liability for death or personal injury where such liability cannot lawfully be excluded;
- any other liability that mandatory law does not permit Mapica to exclude or restrict.
Mapica remains responsible for obligations that applicable law places on Mapica as seller of Mapica products.
Mapica does not control independent travel providers and is not responsible for performance of a separate contract between the Traveler and an independent:
- accommodation provider;
- rail or bus operator;
- attraction;
- car-rental company;
- ticket provider;
- other travel supplier.
This does not exclude liability that applicable law places on Mapica in a particular situation.
35. Privacy
Mapica processes personal data in accordance with the:

The Privacy Policy explains, among other matters:
- what data Mapica processes;
- why it is processed;
- service providers involved;
- international transfers;
- retention;
- account deletion;
- privacy rights.
36. Complaints
For a problem concerning a Mapica purchase or service, contact:

Mapica will attempt to resolve legitimate complaints directly and within a reasonable period.
37. Consumer mediation
Before paid consumer services are commercially launched in France, the future French Mapica legal entity will appoint a consumer mediator competent for its activity where required by French law.
After appointment, this section will identify:
- the mediator's name;
- postal address;
- website;
- other mandatory contact information.
Where applicable, a consumer must normally first attempt to resolve the complaint directly with Mapica before referring the matter to the designated consumer mediator.
The former European Commission Online Dispute Resolution platform is no longer in operation.
38. Governing law and language
After incorporation of the French Mapica legal entity, these Terms are intended to be governed by French law.
For consumers, this choice does not deprive them of mandatory consumer protections that apply under the law of their country of habitual residence.
Nothing in these Terms restricts a consumer's mandatory right to bring proceedings before a court that has jurisdiction under applicable law.
Mapica may provide these Terms in several languages.
Where permitted by applicable law, the French version is the reference version in the event of a material inconsistency between translations.
This does not limit mandatory consumer rights or interpretation protections available under applicable law.
39. Changes to these Terms
Mapica may update these Terms where reasonably necessary because of changes to:
- the product;
- law or regulation;
- payment systems;
- marketplace functionality;
- security;
- third-party services.
Material changes affecting consumers will be communicated where required by law.
Changes will not retroactively remove rights attached to completed purchases.
Where professional Local Creators are protected by applicable platform-to-business rules, changes affecting that commercial relationship will be notified in accordance with the notice periods and procedures required by law.
The current Terms and the “Last updated” date will remain available on this page.
40. Severability
If a provision of these Terms is found invalid or unenforceable, that does not automatically invalidate the remaining provisions.
The affected provision will apply only to the maximum extent permitted by applicable law.
